DEFINITION DU GENOCIDE

Qu'est ce qu un génocide ?
La convention (article II) a apporté les réponses suivantes.

Un génocide résulte de n'importe laquelle des actions suivantes commises dans l'intention de détruire, en tout ou en partie, un groupe national, ethnique, racial ou religieux :
a) tuer des membres du groupe
b) provoquer des blessures physiques ou mentales graves à des membres du groupe
c) infliger délibérément au groupe des conditions de vie telles qu'elles détruisent en tout ou en partie le groupe
d) imposer des mesures de restriction des naissances dans le groupe
e) transférer par la force des enfants du groupe dans un autre groupe

The definitional article included in the 1948 convention stipulates:

Article II
In the present Convention, genocide means any of the following acts committed with intent to destroy, in whole or in part, a national, ethnical, racial or religious group, as such:
(a) Killing members of the group;
(b) Causing serious bodily or mental harm to members of the group;
(c) Deliberately inflicting on the group conditions of life calculated to bring about its physical destruction in whole or in part;
(d) Imposing measures intended to prevent births within the group;
(e) Forcibly transferring children of the group to another group.
The critical element is the presence of an "intent to destroy", which can be either "in whole or in part", groups defined in terms of nationality, ethnicity, race or religion.
